We recognize the importance of users’ privacy and we have committed to respecting it. We care about your privacy and building trust with you is one of our highest and sincerest priorities. This Privacy Statement will explain how MAF LLC, owner of Cerrat, is collecting and using your personal information and how to contact us if you have questions about that collection and use.

  1. Information about MAF LLC & Cerrat

MAF LLC (“MAF”) is a U.S. company headquartered in Dallas, Texas. MAF is the home-grown, family-owned Texas luxury leather goods parent company of Cerrat, and we are dedicated to providing our clients access to a distinctive and exclusive line of luxury products in which footwear and accessories serve as the brand’s hallmark categories.

Cerrat pursues a vision aimed at creating products that, while versatile, remain true to the brand’s DNA rooted in “luxury inspired by western wear fashion.” Heritage, quality and modern elegance are the distinct features of Cerrat that customers enjoy today.                  

MAF is the parent company of Cerrat (trademark) which sells luxury leather goods directly to clients on the Shopify webstore, www.cerratofficial.com (our “Services”). MAF believes in the sincere pursuit of delivering the best customer experience possible, which means taking available measures to protect user privacy and data. As part of this ethos, we believe it is our obligation to let you know what we do with your information and when possible, give you access to your own information when you want it. In this Policy Statement, any references to “MAF”,”Cerrat”, “we”, “our” or “us” or even the “Company” is a reference to MAF LLC and Cerrat based in Dallas, Texas.

  1. Scope of this Privacy Statement

This Privacy Statement applies to MAF (Cerrat) only where we determine why and how we use the Personal Information we collect for sales of our products, customer service, marketing or other legitimate business purposes, and how in that capacity we act as the “Controller” of the data we collect. To be clear, this Privacy Statement does not cover any personal information our customers choose to collect and share with MAF where we are not the Controller, but rather the Processor. Additionally, our Website (“Site”) and Services may contain links to other websites, applications and services from third parties. The privacy and data security practices of those third-party sites are governed by the privacy statements of those third-parties, and not MAF.

 

B. Collection of Personal Information and Purposes of Use

  1. Collection of Information and Its Use

The personal information MAF collects is generally determined by you and your interaction with us, our partners, publications and other resources. MAF uses Shopify to host its website, manage and present our web-store content to our visitors, process and fulfill your orders, as well as market to you in a limited capacity. Neither Shopify or MAF sell your data. We do share data for purposes of limited behavioral advertising (which you have the option to limit and opt-out of), but we do not knowingly sell or allow any of our partners or vendors to sell any of our customers’ data. Period.

                How and where does MAF collect information?

MAF collects information relating to or identifying individuals (“Personal Information”) from job candidates, prospects, customers, participants at our events, business partners and vendors and their employees, advisors, contractors, and individuals who choose to use our Services on other’s behalf (collectively, “Individuals”) who:

  • Visit our Site(s);
  • Receive or send communications from/to us, including email, phone calls, and mail;
  • Use our Services as a customer or authorized user (for example, a retailer logs into their MAF (Cerrat) account as part of their use of our Services);
  • Register for, attend and/or otherwise take part in our events, web-casts, contests, etc.;
  • Download or otherwise engage our content or publications;
  • Submit an inquiry about an order, for support or information;
  • Participate in recorded meetings or events;
  • Engage with our customer service or employees;
  • Apply to work with us, view or share job postings; or
  • Work at a partner or supplier of ours and interact with our company in the course of doing business or contemplating doing business with us.

We collect personal information from a variety of sources, including but not limited to:

  • The person who is the subject of the Personal Information;
  • Publicly available sources (such as a voting record);
  • Third-Party Advertisers we have engaged to do advertising for us;
  • Service Providers; and
  • Business partners and/or vendors.

What type of personal information do we collect?

  • Identifying Information: MAF collects this information when you create a profile, place an order, or take advantage of other offers online or contact us. For example, name, address, zip code, email, telephone and cell number(s), birthdate, credit card information, and security question answers.
  • Payment Information: This information is collected when you make a purchase. For example, your credit card number and billing address.
  • Event Information: This information is gathered when you sign-up for events. For example, contact information and mailing address.
  • Demographic Information: MAF will collect this information when you take part in a contest, promotion, or survey. For example, gender, and zip code.
  • Device Information: We collect device information when you visit our Site. For example, the type of device you use to access our platforms, device ID, IP address or mobile operating system.
  • Location Information: We collect this information about your location when or if your device is set to allow location information. Please see Cookie Statement section below for more information.
  • Commercial Information: We collect this information when you make a purchase. For example, details about the products or services purchased, obtained or considered, as well as other purchasing or consuming histories or tendencies.
  • Internet or other Network Activity Information: We collect this information when you visit our Site, use our mobile apps, or interact with our other technologies. This information is either automatically collected or is customer-initiated. For example, your browsing history, search history, and other information regarding interactions with our Platforms or ads. Please see Cookie Statement section below for more information.
  • Other Information: If you use our Site, we may gather data about the browser you use, what site you came from, or what site you visit when you leave us. When you call our customer service team, we record calls for quality assurance and operational purposes. This information includes things such as pages and files viewed, operating system, searches, system configuration and date/time stamps associated with your usage.
Like most websites and other places on the Internet, our Sites and our Services may use cookies, web beacons, pixels and/or other technologies (collectively, “Cookies”) to gather information. You can manage your consent to Cookies on our site by visiting our Cookie Consent Manger, verified as CCPA compliant and deployed by on our behalf by Shopify.

 

  1. How We Use the Data

MAF collects Personal Information for a number of reasons or purposes, including but not only the following:

  • Product and service fulfillment.
    • Complete, fulfill, manage, and communicate about purchases, etc.;
    • Set up and service your online profile on our Site or apps;
    • Provide customer service and alert you about product or shipping status; and
    • Manage any subscriptions, including order tracking, billing, and any messages with you about those subscriptions.
  • Internal operations.
    • Improve the effectiveness of our Site, web-store, mobile apps, merchandise inventory, and customer service;
    • Conduct research and analytics related to our operations; and
    • Perform other logistics and operation activities as needed.

    • Processing your payments and address any inquiries or requests about your purchase;
    • Offer additional products or services which could be of interest.
  • Security, compliance, legal obligations and fraud prevention.
    • Protect our assets (on and offline) and prevent fraudulent activities;

Sometimes Information is Vital: Where we need to collect and use Personal Information by law, to complete a transaction with your, or fulfill a contract with you, and you fail to provide the Personal Information required, such deficiency is likely to prevent MAF from meeting certain of our obligations.

 

Other People’s Privacy: If you provide us with Personal Information relating to another person, you must confirm you have informed them of our identity and why their Personal Information is required and how it will be used, and they must have given consent to share their information with us. THEY have to consent. Please know you cannot consent for them.

 

  1. Sharing and Disclosure of Personal Information

We may share Personal Information to vetted third-parties for certain purposes, including the following:

  • General Business Purposes: We may share information with consultants and other service providers for customer or technical support, marketing, recruiting, operations, account management, and legitimate general business purposes;
  • Compliance with the Law: We may disclose information to a third-party where we are legally required to comply with applicable laws, regulations, legal processes or government requests.
  • Protection of our Rights: We may also disclose information where it is needed to protect or exercise, establish or defend our legal rights;
  • Business Transfers: We may share or transfer information to support negotiations of or for a merger, sale of company assets, financing, or acquisition of all or a portion of our business;
  • Managing Events: If you use our Site to register for an event or webinar organized by a partner, we may share your Personal Information with that partner to process your registration and ensure your participation in the event; when this happens, our partner will process the Personal Information as a separate controller and their use and control over your Personal Information will be governed by their privacy statement and policies;
  • Receiving Professional Advice: In certain instances, we may share Personal Information with professional advisers acting as processors or joint controllers, including lawyers, bankers, auditors and insurers where we operate, who provide their professional services, but only to the extent we are legally obliged to do so or have a legitimate interest in sharing information;
  • Publicly Shared Information: Any Personal Information or other data you choose to submit in communities, on social media platforms, forums, blogs or chat rooms may be read, collected and used by others who visit these forums, depending on account settings. Your public statements are free to be seen, used and collected if provided publicly.

    C. International Transfers, Security and Information Retention
    1. Use of Personal Information in the US, and Elsewhere

    Our Site servers are located in the United States, and our third-party service providers and partners operate mainly in the United States and Canada. This means when we collect your Personal information, we may process it in these countries. These countries may have data protection laws different from those of your country, but we have in place appropriate safeguards. NOTE: MAF IS A US BASED AND US CENTRIC COMPANY. WE DO NOT HAVE A PRESENCE IN, BUSINESS IN, OR SOLICIT BUSINESS FROM OUTSIDE THE US. With that said, we act to and employ measures designed to reasonably protect the Personal Information we hold, including working with our service providers and partners to maintain the security of our Services.

    We use appropriate technical, organizational and administrative security measures designed to protect the security, confidentiality and integrity of information.

     

    3. Data Retention

    MAF will retain Personal Information we collect from you for the length of time necessary to complete our relationship with you, or there is an ongoing legitimate business need to do so and we have a valid reason to use the Personal Information. We determine the length of our retention periods for Personal Information on the basis of the purposes for the information, the amount, nature and sensitivity of the information used, any potential risk from unauthorized use or disclosure of that Personal Information and whether we can achieve the purposes of the use through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation).When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because it has been stored in backup archives), we will securely store and isolate it from further processing until deletion is possible.

     

    D. Your Privacy Rights

    You may have the following privacy rights:

If you wish to access, correct, update or request deletion of your Personal Information, you can do so at any time by contacting us by sending an email to privacy@cerratusa.com or by using the contact details provided under the “How to Contact Us" heading below. We will of course need to verify you are who you say you are before we provide any access to anyone’s Personal Information. If you do have an inquiry, please provide us with the following:

      b. type of request;
      c. approximate date of collection of the information; and 
      d. a valid email address to contact you.
      2. We provide additional information below for California, Colorado or Virginia residents who wish to submit access, correction or deletion requests. NOTE: We do not have a presence in the UK, EU, Switzerland or other country in the European Economic Area. We do not market or solicit inquiry from those regions, or anywhere other than North America. If, as a resident of the UK, EU, Switzerland or other country in the European Economic Area, you believe we have collected Personal Data from you, you may submit a request to privacy@cerratusa.com to (a) object to processing of your Personal Data, (b) ask us to restrict processing of your Personal Data or (c) request portability of your Personal Data. Again, you can exercise these rights by contacting us through to privacy@cerratusa.com or by using the contact details provided under the “How to contact us” heading below. In any such inquiry, please provide us with the following: id email address to contact you.

        MAF does not use or process any Personal Data or Personal Information which would subject a person to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making"). Automated Decision-Making currently does not take place on our Site or in or as part of our Services.

        3. You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” link in the marketing communications we send you or by using the contact details provided under the “How to contact us” heading below. Please note opting-out of the receipt of marketing communications from us does not opt you out of receiving important business communications related to your current relationship with us, such as communications about your subscriptions or event registrations, service announcements or security information.

        4. You can manage your Tracking Tech preferences by visiting our Inedible Cookie Consent Manager.
        5. If we have collected and used your Personal Information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the use conducted in reliance on lawful processing grounds other than consent.
        6. We have deployed Shopify’s Cookie Consent Manager, which you can utilize to customize your cookie preferences, including to opt-out of targeting cookies for behavioral ads. The Global Privacy Control (“GPC”) signal is a browser setting that allows consumers to opt-out of targeted advertisements and/or the sale of personal information through a pre-determined signal. To set up GPC, you can visit the Global Privacy Control page. We are working with Shopify to recognize the GPC, but at this time Shopify is unable to implement a GPC response. Your use of our Cookie Consent manager will allow similar opt-out preferences as GPC. Some browsers allow a “do not track” (DNT) setting that requests a web application disable its tracking of an individual user. When you choose to turn on the DNT setting, your browser will send a signal to websites, ad networks, analytics companies, and other web services and stop tracking your web browsing activity. To set up DNT, you can visit the All About DNT. If you set up DNT, we will automatically turn off all non-required cookies on our Site for you. Please note this may impact the functionality of our Site or your account.

        We respond to all requests we receive from individuals wishing to exercise their privacy rights under applicable data privacy or protection laws.         This section of our Privacy Statement supplements the information contained above and applies to visitors, users, and others who reside in California, Colorado and Virginia (”consumers” or “you”), in an effort to comply with the California Consumer Privacy Act (CCPA), the Virginia Consumer Data Protection Act (VCPA), the Connecticut Personal Data Privacy and Online Monitoring Act (CPOMA), and the Colorado Privacy Act (CPA) (collectively, the “State Privacy Laws") enacted in those states, as well as others in the future.

            Right to Delete

            You have the right to request that we delete any of your Personal Information we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

            Response Timing and Format


            We will confirm receipt of your request within ten (10) business days. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.             Personal Information Sales Opt-Out and Opt-In Rights

             We do not intentionally collect the Personal Information of consumers and sell, or intentionally share in any way that could constitute a sale for value. We do “share” data as that term is defined under California law, in that we share that data with service providers who conduct cross contextual behavioral advertising on our behalf, such as Facebook and Instagram. You may OPT OUT of such “sharing” via our Cookie Consent Manager. We strongly advise utilizing this tool to avoid tracking cookies.
